The Revised E-Privacy Directive or Directive 2009/136/EC – this is a Directive issued by the EU which is due to be adopted by all EU Member States by 25 May 2011.

18 § /Träder i kraft I:2011-07-01/ Uppgifter får lagras i eller hämtas från en abonnents eller användares terminalutrustning endast om abonnenten eller användaren får tillgång till information om ändamålet med behandlingen och samtycker till den. Detta hindrar inte sådan lagring eller åtkomst som behövs för att överföra ett elektroniskt meddelande via ett elektroniskt kommunikationsnät eller som är nödvändig för att tillhandahålla en tjänst som användaren eller abonnenten uttryckligen har begärt. Lag (2011:590).
Uttryckligen begärt är tex "kom ihåg mig" eller "spara mina inloggningsuppgifter", eller tom "logga in" etc.

Do-not-track kommer förmodligen bli mycket viktigt för att undvika att cookielagen blir en rödgubbe-lag. "Meanwhile, in Europe, the ePrivacy Directive came into force.2 The Directive has been amended by Directive 2009/136 which changes how some cookies are handled, requiring affirmative consent from users for cookies that are not “strictly necessary”. In addition, persistent cookies that contain a unique user ID are classified as personal data. Companies are not sure how to comply with these new regulations without diminishing user experiences online.
In part due to these concerns, the cookie directive will not be enforced for a year. Regulators are considering whether DNT could eventually become a mechanism to establish consent to cookies."
" In Europe, a few policy makers at the national and country level have started to endorse the idea of DNT, including the Minister of the Department of Media, Culture and Sport in the United Kingdom and the Vice President of the European Commission’s Digital Agenda. Both policy makers are pushing for DNT support by mid-2012"
